I have a 30% Service Connected Disablity that I am recieving compensation for. In Feb. 09 I had surgery for this Disability that Restricted me from working. During this time of convelesance I received 100% Disability pay. I have yet to be released to return to work and the Convo. pay was only for 3 months which i didnt get until July 1 09. During this time of not working I was unable to pay my child support of $115.00 per week. Went to court this past monday and the judge found out I got the convo. pay and ordered me to pay $1500.00 or it for arrearage child support. My question is can she leagally do this? I know I am responsible for paying my child support and I have been up until i was out of work from Surgery. Even though i am still not working and only drawing $519.00 per month she has not made any adjustments to my weekly amount. My monthly Child support amount to be paid is $517.50. How can she keep this amount with me only drawing $519.00??? What about the wife and 2 kids I have now? I guess she is saying "to heck with them"
Any Help on this subject will be greatly appreciated. |
