In sept of 2004 I was discharged as an e-2 with a gen under honorable for a pattern of misconduct. I went to mast two times in a 4 month period. From the beginning.. I was a frocked E-5 in May 2004. Because of the upcomming deployment was near I had necessary personal business to tend to for my divorce. I discussed this with my chain of command and was given permission to be away from work for a day. I was than placed on report for ua. I never saw the report chit and never signed it either. MY record at this point was clean. No counseling, numerous awards Flag letter, letter of appreciation, good conduct good evals of 3.86 and 3.14, junior sailor of the month and quarter. Well I was busted down from e-5 to e-4. I was removed from the corrosion shop where I was very knowelegable and aware of the duties and reassigned to the airframes shop. I went siq for a foot injury on the ship. OIne day during siq and on my6 way back to berthing from chow I went thru the library which is the way I had to go due to secured spaces. I grabbed a book of the shelf as I walked thru didnt even care what it was about but to keep me occupied while siq. I was than placed on report for disobeying and order, busted down to e-2 and discharged. Does any of this seem funny to any of you?

Bryan, that is a very interesting but not very funny derogatory story. I assume that the Navy has lots of those and the result is 'get rid of him'. But what is it that you want to know from us? Perhaps there are some Navy guys in this forum who can console you.

I am processing with the navy right now and stories like this are quite scary. How often does this happen?

Dude that is exactly what I need. I have found so many mistakes with what happened to me that I am pissed. I didnt do anything to warrant discharge. I had a chain of command who gundecked a few things and than I got out of hand. I was left to suffer the consequences.

More often than you think. If a command screws up who do you think they will throw to the wolves. Not the Chiefs or officers.

bryan ..in the first place I am not a Dude and in the next part I find it very hard to believe a whole chain of Command gundecked the whole process begining from a Report Chit all the way up to a unfit Discharge.Just one question what was the charges read at each Captain's Mast.

Sully, My apologies. I was red for article 86 UA and article 92 fail to obey an order. It can be true that they gundecked the whole thing. Are you familiar with the term of POIC. I never had a formal investigation that I was having an NJP. I never saw a report chit. When I questioned how things were being handled I was punished. I tried to go thru the proper channels to report this but my command just put me into more serious trouble for it.

bryan ...I know that there is a JAG Corp in the Military and come rain or shine there is no way in Heck that you can be booted out if you follow proper channels.

It sure happened. I went as far as to contact my congressman before I got booted. That didnt get far and when the command found out I was put on restriction from e-mail, phone and all my snail mail was screened. I talked to jag but they wont help because I am a cavilian even though I had contacted them before this mess got serious and I was booted.

Geez o pete! When presented with notification that you were up for NJP and you knew it was bogus, why didn't you insist on a court martial?

I had 4 NJP's all from the same individual for UA, disobeying lawful order, missing movement, and striking a SNCO. When he tried to write me up the fifth time I asked for the court martial and all of it came to a grinding halt. Within 9 months of that last one, I was promoted meritoriously and re-enlisted. Never lost a stripe, just was fined and restricted to barracks and base.

Didn't you ever approach the Command Master Chief and present your side to him?

Perhaps if you gave a bit more info on the whole scenario? As it is, the case seems questionable for both sides, and without more details on your situation, its a bit hard to determine what the real issue is here.

I myself escaped a dishonorable discharge back in 2005, due to gundecking. My processor at MEPS omitted some key information regarding some things I did in my past, and in return it came back to bite me when I went for my TS. I eventually had to give a full detailed report on everything that showed as a "red flag" on my SF-86, and DoNCAF had to either approve retention, or separate me.

So, with that said, you should probably try giving more details about your incident, that way its easier for people to know whether you were given a negligent discharge, or if it was warranted.
