It's kinda hard to fall off the grid forever, especially when the grid encompasses the majority of the world. Even if he heads south, there's a good chance he'll run afoul of the local law, or federalies at some point. Not all borders are as porus as ours.

all that matters here is that he is in custody, even if he is in a mexican jail. Not a fun place to be concidering what he did.
