Hi there. My fiance moved to Missouri for school after completing his 4 years of active duty, and found out that to gain benefits from the Heroes Act, his Home of Record must be in Missouri. It's not- it's listed as New York.
Is there any possible way to change his Home of Record to a different state? The VA rep at our university said that some people have been able to, and some haven't. He's trying to call Lifelong Education Center at Mobilization Command, but even though he's called 70 (seriously, seventy) times in the past few days, they won't answer their phones. He's also called Mobilization Command number on the DD-214 form, but they recommended he call the VA (???). The lady there hadn't even heard of the Heroes Act (which is strange, seeing as Googling it brings up a LOT of hits...), and said that it's probably "just a state thing" and not a federal benefit, and "you have to clear that up with your school," which sounds like stuff she just made up on the spot. I know the Home of Record is the state where he lived where he first enlisted, but is there any possible way to change it to a different state? Any info would be appreciated!! ~Laura |

OK, first off, you really need to look up the actual Hero's Act that was passed if you are referencing it. Strongly recommend you locate the part that you believe pertains to you. This way you can present it to those you are seeking assistance and or benefits from.
If your husband enlisted in New York, then his HOR will remain New York. One cannot change Home of Record to obtain benefits from any other state. Yes, I was told the same thing. You can only change your home of record once, and it has to be while on active duty.
Not that this is THE answer to your issue (I'm not a lawyer or anything close to it), but what I was told when I did inquire about this while I was active duty. Your home of record can get you various tax breaks and educational costs breaks. To be able to change it all the time is "cheating the system", so it's not easy. And might not be possible in this case. |

Thanks for the replies, and for the link, Coachman! The VA rep for our university said that changing it would be an iffy thing, and said that she recommended that we at least look into it.
And thanks for your reply, thegunny, but as I wasn't really asking about the particular Heroes Act that was passed in our state, merely about the Home of Record, I didn't think it was necessary to answering the question. |
