Have to agree. This really pisses me off. It opens up the doors to more of this for those aquitted during a full military court martial.
I am on the record in here in favor for allowing the military justice system to work for those Marines involved with questionable incidents over there. Even that stance drew criticism from my peers in here. Too bad, I still stand by that view. Never thought for one minute that NCIS would pull such an end around to get a conviction. That may work in Navarro's favor and his lawyer should be quick to point this out. His lawyer also needs to point out that actor Mark Harmon isn't driving this train. Wouldn't surprise me if the TV show NCIS runs a show based loosely on this incident, if they haven't already done so. JAG used to do that to draw in viewers. Hope they do because that alone would be fodder for a mistrial..... I agree with you gunny, once tried and found not guilty that should end it once and for all, that said who's driving the train on this?

Looks to be NCIS, couldn't make the case in a full blown court martial, and decided to take this route to get him.

I agree Gunny -- once is enough.
