one of my soldiers was recently involved in a dispute with a nco. The nco violated a safety issue and my soldier reported him. After the NCO was confronted bye an officer he went out and started yelling at the soldier and told him to start pushing. The soldier told him that the ground was way to hot to push on and that he didnt have his gloves on him so that he wouldnt burn his hands. The NCO wants me to councel and recomend UCMJ actions for this soldier but I feel my soldier was in the right and that the NCO was in the wrong. Can some one please help me find some army regulation that has to do with any of this. I am trying to help my soldier who shouldnt be introuble

There should be an order from the post commander or some higher authority that dictated the "training" and its methods that depends on the environmental conditions on that day.

Hmm, location, time of day, temperature, ground consisted of what? concrete, grass, sand, blacktop, gravel, combination of all of the above? There are such things as lawful orders. Sounds to me like someone actually needs to speak to the command Sgt Major and get him involved. Handle this at lowest levels first.

If this gets escalated (read getting Zero's 'officers' involved) better have all your facts together. As Harry stated, what were the Post order of the day concerning activties?

Also you need to know what type of counseling record that for lack of a better name zero has. Also as gunny and Harry stated what were the post directives for training that day. Has this soldier and the NCO been having problems in the past? If so were the recorded in any counseling sessions and if so did the soldier dispute these? You also need to use the proper procedures when you take up this fight, remember proper chain of command.


Count it the greatest sin to prefer life to honor, and for the sake of living to lose what makes it worth living.
