Yogi, it's not that, but a junky neighborhood ruins the resale value for others in that neighborhood. The way I look at is, if you want to have a car up on blocks, at least have the common decency to have it somewhere inconspicuous.

Cedar, yep, to apply it to something after the fact isn't morally right. The sad thing is that the ACLU won't even address issues like those. I contacted them about my very own homeowners association. They basically told me to go find someone else, they weren't interested. They didn't even have the decency to point to someone willing to help. Unfortunately, this battle will fall on your shoulders. You will probably have to wind up going to court over the entire issue. Here, we are about to enter into a very expensive and ugly battle with the townhome owners within the association. If you care for any assistance in this matter, feel free to PM me.

I have a '68 35' HOUSEBOAT sitting in the back yard and a '69 34' travel trailer sitting in the driveway! I LIKE living this way. FREEDOM means something to me. I MAY fix em up OR I may sell em...dunno yet...

It's pretty easy when one does the research and discovers that some of them are in violation of Federal & State law !!! e.g., No satellite dishes ?!?!?!? For the record, if your house trailer and boat are kept in good order, I have no problems with that. Age doesn't matter. And, as far as condition goes, as long as there aren't parts all over the yard and your place doesn't look like a trash heap, I don't care about that. Of course, it's all dependant upon where you live. I am all for a landowner's inherent rights, believe me !! I was one of the few that supported the battle against the last city I lived in about boats/ RVs in the driveways. Seems that they had an illegal ordinance against them being in a yard or driveway for more than a week. THAT ordinance got rescinded !!

BTW, I am NOW the ELECTED president of our association. It is run more moderately and with the homeowner in mind. The townhome owners were the worst complainers. They don't complain so much anymore !! Wink

Unfortunately, our covenants were written with good intentions, but little foresight and it still boggles my mind how some of this stuff got past the lawyer. Confused Anyways, people are happier here than they were. That's what counts. I'm working on changes to the covenants, but it's really difficult to actually get them changed because of the apathy. Honestly, I can't say we are even legal electing officers & board members. But, no complaints, so, I keep trying. Personally, I'd like to see ALL the covenants go away and stick to city ordinances.

I think we are in the same book, just on different chapters.

If you are a member in a homeowners association then you have every right to enforce the homeowners association rules, regulations, restrictions, and guidelines already established and in place at the time you joined.


You entered into an agreement with specific guidelines. These are rules already set in place.
You accepted them with the understanding they would apply to all new comers.

Now to my intended point.
You do not appreciate any one coming into your association and telling you how to run your homeowners association (business) you attained through your own sweat.

Yogi is also 100 percent correct. He bought property with out any homeowners association restrictions. He bought his property fully expecting not having to deal with or accepting any homeowners association regulations.

Now to my intended point.
Yogi does not appreciate any one coming around telling him how to manage his personal and social affairs (business) attained through his own sweat.

Does this make any sense?

Well, being an FCC licensed tech, I wouldn't have a problem with it. Even if I had to recable the house with quad shield RG6 !! But, unfortunately, where I live, that wouldn't be allowed. Like I said, I'm trying to get the covenants changed. Hell we have two choices in what kind of siding we can use, cedar or brick!! How fkn goofy is THAT ?!?!?!?

And yes, we bought this house, covenants and all. I had my reservations when we did and some of my fears came to surface with the covenants.

Now, in MY uneducated opinion, since the antenna wasn't in place before the ordinance was passed, it can't be grandfathered in.

However, there is this thing about reasonable rights & enjoyment of one's property. You may want to check around the net and see what's out there. That's where I got a good start on combatting my Homeowner's Association. Being a Vet², you should also be used to researching stuff. All of our state laws are available online. Look on your applicable state site & see what you can find. In addition, look at the FCC laws, especially those passed in 1996(actually signed into law in 97). If I recall, there are some inherent problems with operating a ham radio in a residential area, mainly that of ingress into the local resident's TVs, radios and cable systems. It kind of depends on how much power you intend to push.

There's also the option of requesting a variance through the city.

Bear in mind, I'm not a lawyer and will not pretend to be. These are just some of the things I've learned over the years.

Yogi, had it my way, we would be living on some acreage out in the middle of nowhere !! A place where I could hunt, shoot my guns whenever I felt like it (within reason), pee in the yard, and have a bunch of animals, have a big assed pole barn so I can have ALL of my vehices available to work on, etc. However, I must consider the rest of my family. Besides, I look at our places to live as an investment. That train of thought has proven worthwhile. What other market will give you 100% return in your investment in 5 years ?? Makes sense to me.
