I contacted them about my very own homeowners association. They basically told me to go find someone else, they weren't interested. They didn't even have the decency to point to someone willing to help. Unfortunately, this battle will fall on your shoulders. You will probably have to wind up going to court over the entire issue. I was one of the few that supported the battle against the last city I lived in about boats/ RVs in the driveways. Seems that they had an illegal ordinance against them being in a yard or driveway for more than a week. THAT ordinance got rescinded !! BTW, I am NOW the ELECTED president of our association. It is run more moderately and with the homeowner in mind. The townhome owners were the worst complainers. They don't complain so much anymore !! Unfortunately, our covenants were written with good intentions, but little foresight and it still boggles my mind how some of this stuff got past the lawyer. Cedar, how much "dirt" ya got to sell ?? I think we are in the same book, just on different chapters. If you are a member in a homeowners association then you have every right to enforce the homeowners association rules, regulations, restrictions, and guidelines already established and in place at the time you joined. You entered into an agreement with specific guidelines. These are rules already set in place. You accepted them with the understanding they would apply to all new comers. Now to my intended point. You do not appreciate any one coming into your association and telling you how to run your homeowners association (business) you attained through your own sweat. Yogi is also 100 percent correct. He bought property with out any homeowners association restrictions. He bought his property fully expecting not having to deal with or accepting any homeowners association regulations. Now to my intended point. Yogi does not appreciate any one coming around telling him how to manage his personal and social affairs (business) attained through his own sweat. Does this make any sense? Now, in MY uneducated opinion, since the antenna wasn't in place before the ordinance was passed, it can't be grandfathered in.
However, there is this thing about reasonable rights & enjoyment of one's property. You may want to check around the net and see what's out there. That's where I got a good start on combatting my Homeowner's Association. Being a Vet², you should also be used to researching stuff. All of our state laws are available online. Look on your applicable state site & see what you can find. In addition, look at the FCC laws, especially those passed in 1996(actually signed into law in 97). If I recall, there are some inherent problems with operating a ham radio in a residential area, mainly that of ingress into the local resident's TVs, radios and cable systems. It kind of depends on how much power you intend to push. There's also the option of requesting a variance through the city. Bear in mind, I'm not a lawyer and will not pretend to be. Yogi, had it my way, we would be living on some acreage out in the middle of nowhere !! A place where I could hunt, shoot my guns whenever I felt like it (within reason), pee in the yard, and have a bunch of animals, have a big assed pole barn so I can have ALL of my vehices available to work on, etc. However, I must consider the rest of my family. Besides, I look at our places to live as an investment. That train of thought has proven worthwhile. What other market will give you 100% return in your investment in 5 years ?? Makes sense to me.
